PlayQuest Terms of Use

These Terms of Use (“Terms”) set forth the conditions for using “PlayQuest” (the “Service”) provided by Cresc LLC. (“the Company”). By using the Service, users (“Users”) agree to be bound by these Terms.


Article 1: Scope of Application

  1. These Terms apply to all matters relating to the use of the Service between the User and the Company.
  2. In addition to these Terms, the Company may establish separate terms or rules (collectively, “Supplementary Rules”). If any Supplementary Rules exist, they shall form part of these Terms, and if any conflict arises, the Supplementary Rules shall prevail.

Article 2: Use of the Service

  1. Users may use the Service in accordance with these Terms and any applicable guidelines.
  2. The Company may modify all or part of the Service without prior notice to the User, at its sole discretion.

Article 3: Registration

  1. Users must agree to these Terms and complete the registration process as determined by the Company.
  2. The Company may deny registration if any of the following apply:
    • The applicant has provided false information.
    • The applicant is a minor, adult ward, or under guardianship and has not obtained legal consent.
    • The applicant has violated these Terms in the past.
    • The Company otherwise deems the registration inappropriate.

Article 4: User Account and Responsibility

  1. Users are responsible for managing their account credentials (e.g., email address and password).
  2. The Company shall not be liable for any damage caused by inadequate management, misuse, or unauthorized use of the User’s credentials.
  3. If account credentials are found to be stolen or misused, the User must immediately notify the Company.

Article 5: Fees and Payment

  1. The Service may include paid features. Payment methods, pricing, and billing periods shall be determined separately by the Company.
  2. Payments made are non-refundable unless required by law or explicitly stated by the Company.

Article 6: Prohibited Conduct

Users must not engage in the following when using the Service:

  • Violating laws or public order and morals.
  • Criminal or fraudulent activity.
  • Infringement of intellectual property rights.
  • Unauthorized access or actions that overload the Service’s infrastructure.
  • Disrupting the operation of the Service or other users’ experience.
  • Impersonating the Company or others.
  • Promoting religious, political, or ideological agendas.
  • Collecting personal data without consent.
  • Other actions the Company deems inappropriate.

Article 7: Suspension and Termination

The Company may temporarily suspend or terminate the User’s access to the Service without prior notice if:

  • The User violates these Terms.
  • The Company detects unauthorized use of a User’s account.
  • System maintenance or emergency issues arise.
  • The Company otherwise deems suspension necessary.

Article 8: Withdrawal

  1. Users may delete their account and terminate their use of the Service through the method specified by the Company.
  2. Even after withdrawal, the Company may retain usage records or data for a reasonable period in accordance with its Privacy Policy and legal obligations.

Article 9: Intellectual Property

All intellectual property rights related to the Service (including all content, systems, and software) belong to the Company or its licensors. Use of the Service does not grant Users ownership or rights beyond those explicitly stated.


Article 10: Changes to Terms

The Company may modify these Terms at any time. Significant changes will be notified in advance through the Service. Continued use of the Service after changes constitutes agreement to the revised Terms.


Article 11: Disclaimer and Limitation of Liability

  1. The Company provides the Service “as is” and does not guarantee accuracy, completeness, or availability.
  2. The Company shall not be liable for any damages arising from:
    • Service interruption or termination.
    • Unauthorized access or data breaches.
    • Disputes between Users or between Users and third parties.
  3. If the Company is held liable for any reason, its liability shall be limited to the amount paid by the User to the Company in the past 12 months.

Article 12: Handling of Personal Information

The Company will handle personal information obtained through the Service in accordance with its Privacy Policy.


Article 13: Notices and Communication

Unless otherwise specified, communications between the User and the Company shall be conducted through the Service interface or via email.


Article 14: Assignment of Rights and Obligations

Users may not assign, transfer, or pledge their rights or obligations under these Terms without the prior written consent of the Company.


Article 15: Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 16: Provisions Regarding Anti-Social Forces

  1. Users represent that they are not and will not be affiliated with organized crime groups or other anti-social forces.
  2. If this representation is violated, the Company may immediately terminate the User’s access to the Service without any compensation.
